Revolutionary New Legal Strategy!

Next time you find yourself in trouble with the law simply follow the lead of TomDeLay and...subpoena the prosecutor!

"In a rare move Tuesday, lawyers for U.S. Rep. Tom DeLay subpoenaed prosecutors' records and asked a judge to disclose the secret proceedings of three grand juries that considered felony charges against the former U.S. House majority leader."

"By law the proceedings are secret, but DeLay's lawyers want to penetrate the closed-door deliberations in an attempt to prove allegations of prosecutorial misconduct by Travis County District Attorney Ronnie Earle. In media interviews and court filings, the lawyers for the Sugar Land Republican have portrayed Earle, a Democrat, as running an improper investigation."

Specifically, DeLay appears to have some issue with the prosecutor's particular conduct towards the grand juries that recommended indictments against him. There's really not a chance in the world that he can hope to get the indictments tossed out, but I have to say as far as defense tactics go, this is pretty novel and aggressive. Will history perhaps remember DeLay for pioneering new defense tactics instead of his rampant corruption? Only time will tell!

This is a quote from Delay's lawyer:

"If you did nothing improper, you should not be concerned about answering these questions," DeGuerin wrote. "Eventually, all the information will come out. It always does. In such cases it is always better for public officials to voluntarily disclose, and do it quickly, rather than to be forced to do so by a court of law."


So if he and DeLay feel that to be true, why are they afraid to go to trial?
